STATUTORY MARINE "AS-IS" DISCLAIMER (KRS § 355.2-316): This watercraft, outboard motor, and trailer are transferred strictly in "AS-IS, WHERE-IS" condition, WITH ALL FAULTS AND DEFECTS, WHETHER KNOWN OR UNKNOWN. The Seller disclaims all warranties of any kind, express or implied, including warranties of seaworthiness, merchantability, or fitness for a particular marine purpose. The Seller assumes no liability for post-transfer repairs, hull delamination, motor compression loss, transom integrity, or electrical/trailer defects. Buyer acknowledges having had full opportunity to conduct a marine survey, lake test, or mechanical inspection.
PENALTY OF FALSE SWEARING AFFIRMATION (KRS § 523.040 & KRS § 138.460): We hereby swear and affirm under penalties of false swearing that the purchase price stated is the true and total consideration paid, and that Seller is the lawful owner with unencumbered title. Basis for Kentucky 6% Motorboat Usage Tax.
